June 29th, 2006, Tomasz RychlickiThe Supreme Court in its judgment of 30 March 2006, case file III CZP 14/06, held that a legal advisor who makes the first procedural step and is acting as a representative of legal person, should under the pain provided in the law, attach power of attorney and a document showing that a person, for instance a CEO, who empowered the adivisor had all required powers to issue such POA. The evidence of such powers can be a copy of an extract from appropriate register of commercial companies that was authenticated by a legal advisor himself.
