September 3rd, 2010, Tomasz RychlickiThe Supreme Administrative Court in its order of 28 June 2010 case file II GPS 1/10 held that provisions of Article 272 § 1 of the Act on the Law on proceedings before administrative courts – PBAC – (in Polish: Prawo o postępowaniu przed sądami administracyjnymi) of 30 August 2002, Journal of Laws (Dziennik Ustaw) No 153, item 1270, with later amendments, serve as the basis for resumption of proceedings in administrative courts, whenever the ruling of the Constitutional Tribunal on compliance of the provisions of substantive and procedural with the Constitution, international agreement or act, concerned a legislative act, which was applied or should be applied before the administrative court or public authority in a given case.
