New TLDs, new challenges

Friday, June 27th, 2008

I did a post at class46.blogspot.com website.

The new decision will allow companies to register their brands as generic top-level domain names (TLDs). For instance, Microsoft could apply to have a TLD such as ‘.msn’, Apple could apply for ‘.mac’, and Google for ‘.goog’

You’ve probably noticed that I do not post so often lately. That’s because I’m involved in different projects. I was also invited to join the Editorial Board (Copyright, Related Rights and Designs (including sui generis database right)) of Journal of Intellectual Property Law & Practice which is published by Oxford University Press. But I promise, I will write and post some information here.

Domain name front running

Friday, October 26th, 2007

The Internet Corporation for Assigned Names and Numbers (ICANN) has begun an investigation into accusations that some insiders may be using inside information to collect data and purchase unregistered domain names that get a lot of DNS lookup requests—nonexistent domains that surfers frequently try to access. ICANN refers to the practice as “domain name front running”.

ICANN’s statement is available at www.icann.org website, PDF file. You will find more details about this issue in the article available at www.arstechnica.com website.

Cybersquatters will be happy

Saturday, October 20th, 2007

The Register Prohibited Clauses contains contractual clauses found unlawful by a legally binding judgement of the Court of Competition and Consumer Protection. Based on the judgment of the Court of Competition and Consumer Protection from December 26, 2006, act signature XVII AmC 170/05 there won’t be so easy to get cybersquatters before any ADR court.

Internet domains and different groups of interests

Saturday, October 13th, 2007

The International Federation of the Phonographic Industry has a website which is available at www.ifpi.org and The International Federation of Pirate Interests will have a website available at wwww.ifpi.com soon. More details about this “strange” situation are provided in the article available at www.torrentfreak.com website. International Trademark Association has issued a statement about domain names in the aspect of cybersquatting lately. I wonder if or rather when this case will land before the World Intellectual Property Organization arbitration.

On October 9, 2007, The Polish Pirate Party has filled all documents needed to fully register its political activity. There is also an iterview with Błażej Kaczorowski, the founding father of the PPP, available at www.torrentfreak.com website.
